PRIVACY INFORMATION

  • It is in APCOA’s legitimate interests to accept bookings for use of the Car Park as well as to regulate parking by those using the car park in accordance with such a booking. Also, you enter into a contract every time you book to use the car park as well as every time you make use of it. This includes your agreement to your information being processed as part of the contracts you make to use the car park.
  • On entry to and while you are using the car park APCOA collects and processes certain data to make sure that the booking made by you and the conditions that apply to your booking (which include the terms set out above and those displayed at the car park are complied with and to enforce these where necessary. This may include obtaining the registered keeper’s name and address from the DVLA in order to send a Notice to Keeper, any related correspondence and any further notices if a Parking Charge becomes payable and/or remains unpaid.
  • APCOA will also use the data it collects for car park management such as reporting on vehicle turnover and repeat visits in order to improve the customer experience. The data we collect may include images of vehicles using the car park and/or their vehicle registration mark. This can be collected via ANPR cameras and/or attendants on site as well as via payment machines or terminals.
  • APCOA may share data from time to time as required to support the purposes stated above and may pass data to the police if we have reason to think that a crime may have taken place. If relevant and appropriate, APCOA may also, from time to time, share the data it has collected with a client who has appointed it to manage the Car Park.

  1. AGREEMENT

1.1. Ordering parking at https://www.scanpay.apcoa.ie will result in an agreement between the customer and APCOA PARKING IRELAND Limited.

1.2 When you park in our car park you are accepting our offer of parking and these Terms and Conditions by simply parking on the premises.

1.3. The parking space in the parking area will be unspecified.

1.4. This booking does not guarantee the customer a parking space nor is a parking space reserved for or allocated to them. Parking is on a first come first served basis. Although such reserved spaces may be available at some of our car parks, these have to be purchased through a separate application process.

1.6.   1. CHANGES TO THE TERMS

2.1 If you use our services as a guest, you should regularly check our current terms and conditions before you make a payment to ensure that you are happy with any changes we make to them. Our terms are updated on a regular basis and were last updated on 22 December 2022.

  1. ORDERING

3.1 The customer can make a payment for parking online at https://scanpay.apcoa.ie/, Parking can only be ordered for one car at a time.

3.2 When booking, the customer must choose between price and length of stay.

3.3 After completing booking and payment a confirmation will be sent by email to the customer. The customer will be presented with the option of how they wish to receive their receipt either by email confirmation or the option to print the receipt.

3.4 Ordering is binding and when the customer has received a booking confirmation a definitive agreement between the parties has been created.

3.5 It is your responsibility to ensure that your parking has been confirmed. Do not assume that it has been confirmed just because your payment has been successful.

  1. PAYMENT

4.1 A parking fee is paid for parking at the selected APCOA ScanPay Car Park. The amount depends on the period of time (for example the number of hours /days) selected.

4.2 In addition to the parking fee charged a convenience fee may be charged depending on the selected car park location. The convenience fee may not always be displayed on signage at an applicable car park however it will be displayed on the booking page before the customer makes payment with their payment card.

4.3 Payment by credit/debit card requires the customer to enter their card number, expiration date and security code.

4.4 In the event that a customer decides to exit the car park before the parking period has expired no refund will be issued to the customer.

4.5 We reserve the right to refuse any payment method but will usually accept major credit and debit cards.

4.6 You authorise us to charge your payment method if you make a booking with us.

4.7 All charges are inclusive of VAT.

4.8 If a customer decides to leave the car park area after expiry of their parking period and no payment is made for any additional period spent in the car park for whatever reason then unless an issue arises under clause 10 this will deem the customer in breach of our parking conditions that are on display in the car park concerned and the customer will be liable to pay for any extra time spent in the car park and if the customer fails to do so a penalty charge notice (PCN) may be issued against the customer by us which they will be liable to pay.

  1. LIMITATION OF OUR LIABILITY

5.1 All vehicles are left at the risk of the person who parks the vehicle in the car park.

5.2 Our maximum liability to you for any claim arising in connection with the Services shall be the cost of parking product purchased.

5.3 Our ScanPay Services provides a means of payment only, and you agree that we shall not be liable to you for any loss or damage you may suffer by using parking facilities at any Parking Location.

5.4 We shall not be liable to you for any failure of our services caused by circumstances beyond our control – for example a failure in parking service provider’s banking system that prevents it from receiving your payment.

5.5 We make no warranties or representations with respect to the Services other than as expressly set out in these Terms and Conditions. We make no warranty or representation that the operation of our website or any other part of our services will be uninterrupted or error free and we shall not be liable in any way to you for the consequences of any interruptions or errors.

5.6 To the fullest extent permitted by law you agree that we shall not be liable for any consequential, incidental or indirect loss or damages, for any loss or damage whatsoever arising from or in any way connected with your use of the Services, including, without limitation, damage for any loss in business projects, loss of profits, loss of privacy, consequences of your use that were beyond our reasonable control, or other consequential losses arising in contract, tort or otherwise from the use of or the inability to use the Services.

5.7 Nothing in these Terms shall restrict our liability for:

  • fraudulent misrepresentation;
  • death or personal injury resulting from our negligence or that of our agents or officers; or
  • your statutory rights (including a right to receive a reasonable standard of service).
  1. PRICE
    • The price is quoted in Euros (€) VAT.

 

  • Prices are subject to change. The current price for the car park being used in connection with the ScanPay transaction are on display in that car park.

 

  1. RIGHT OF CANCELLATION

7.1 Payment for parking is non-refundable.

  1. RESPONSIBILITY

9.1 All vehicles are left at the risk of the person who parks the vehicle in the car park. APCOA Parking Ireland accepts no responsibility for accidents, theft, damage to persons, vehicles, equipment, and effects in the car. APCOA Parking Ireland is also not responsible for incidental and consequential damages.

  1. FORCE MAJEURE

10.1 If delivery of the service is delayed or prevented as a result of unforeseen circumstances over which APCOA Parking Ireland have no control, including but not limited to war, mobilization, acts of terrorism (including threats of such), fire, strikes, boycotts, blockades and lockouts, epidemics and pandemics (including among staff at ScanPay Car Park), or natural disasters the delivery of service shall be postponed until the unforeseen circumstance is rectified and neither party shall be liable in such circumstances to the other.

10.2 APCOA Parking Ireland cannot be held responsible in cases of force majeure.

11.1 Any dispute arising in connection with these terms and conditions shall be governed by English law.
